1. Definitions

1.1. „Donation”: a voluntary financial contribution made by the Donor to the Foundation via the Website through an online platform established for this purpose.

1.2. „Donor”: a natural person or legal entity that voluntarily provides financial contribution to the Foundation from their own resources without consideration in return.

1.3. “Foundation”:

1.4. “Parties”: Collectively refers to both the Foundation and the Donor.

1.5. „Website”: the official website created and maintained by the Foundation for the purpose of fundraising (https://willfoundation.eu/).

2. Introductory provisions

2.1. The present Terms and Conditions (hereinafter referred to as “Terms”) delineate the conditions under which may be made to the Foundation and outline the rights and obligations of both the Foundation and the Donor. These Terms apply to fundraising activities conducted under the domain www.willfoundation.eu.

2.2. The purpose of the Foundation is to use the donations in accordance with the Foundation’s objectives, which are the following: empowering women leaders in Hungary and the Central Eastern European region, supporting the promotion of female mid-level managers to senior leadership roles through domestic and international educational programs, research initiatives, events, publications, and awareness-raising activities. 2.3. The Parties acknowledge that the Foundation is the maintainer of the Website and is fully responsible for its operation.

3. Conclusion of the contract

3.1. In order to conclude the Grant agreement, the Donor must execute a monetary Donation to the Foundation by bank transfer or by utilizing the „Donate” feature on the Website. By engaging this feature, the Donor indicates intent to provide a Donation from their own resources.

3.2. The Foundation shall publish the current Terms and its Privacy Policy on its Website, making them accessible to anyone. The Donor accepts the provisions of these Terms and the Privacy Policy by proceeding with either donation method, and the Grant Agreement between the Parties is automatically established at the conclusion of payment or bank transfer without any further action.

3.3. The Foundation acknowledges the acceptance of the Donation with gratitude and commits to utilizing the funds in alignment with the purposes specified in section 2.2.

3.4. The Donor confirms that they will not receive any financial or material benefit from their Donation.

4. The donating process

4.1. Donations can be made through the following methods:

4.1.B. using PayPal’s services.

4.2. Donations to the Foundation are accepted by bank transfer in HUF currency.

4.3. Donations to the Foundation are also accepted through PayPal, utilizing PayPal services. The Donor may select their preferred method of Donation (one-time, monthly, or yearly) and specify the amount to be contributed. The Donor may proceed by logging into their PayPal account or opting for credit card payment, thereby completing the transaction.

4.4. The Donor’s credit card data are not processed by the Foundation. Parties acknowledge that the Donations processed through PayPal are governed by PayPal’s Terms and Conditions in force at all times. The Foundation is not responsible for any issues, defaults, or errors occurring within the PayPal system, including but not limited to payment processing failures, security breaches, or data inaccuracies.

4.5. All donations are voluntary and non-refundable once processed.

4.6. The Donor represents and warrants that they have the authority to make the donation and that the funds provided are not derived from any unlawful activities.

5. Legal nature of the Donation

5.1. The provision of the Donation is not classified as a domestic sale of goods or services provided in exchange for consideration, therefore the Foundation is not obligated to issue an invoice for Donations.

5.2. The Donation is not classified as a public donation.

6. Termination of the Grant agreement

6.1. The Grant agreement shall be considered terminated upon the completion of the one-time credit card payment.

6.2. The Donor is under no obligation to provide any further contributions beyond the Donation expressly made.

6.3. The Parties declare that they may terminate the Grant agreement or refuse to perform their obligations only in the event of material breach of contract by the other Party. Any misuse of the Donation that contravenes the Foundation’s intended purposes will be regarded as a material breach.

7. Waiver of the Right to Reclaim

7.1. The Donor knowingly waives the right to reclaim the Donation without conditions or limitations.

8. Governing Law

8.1. The provisions of the Hungarian Civil Code (Act V of 2013) shall prevail in matters not regulated in detail in this contract. 

By making a Donation, the Donor acknowledges that they have read, understood, and agreed to these Terms in their entirety.
